A defense attorney requested that his case be dismissed against an attempted murder defendant due to a lack of evidence on Feb. 6.

Defendant Jeremiah Jackson and his attorneys Lauren Dollar and Robert Linthicum appeared in front of Baltimore City Circuit Court Judge Stewart Lynn to begin trial but instead asked that the case be dismissed.

Defense counsel argued that the prosecution allegedly had exculpatory DNA, was not present during the trial, and failed to provide other evidence relevant to their case. Judge Stewart rejected the motion to dismiss without the prosecution present, saying the defense was aware that the prosecutor assigned to the case would not be there.

The defense reiterated their desire to dismiss the case to Baltimore City Circuit Court Judge Melissa Phinn in reception court later that day. Judge Phinn also denied the motion to dismiss the case because the prosecuting attorney was not present.

Judge Phinn postponed the trial date until July 11 in which the 17-year-old defendant will face charges of attempted murder, assault, firearm use in a felony violent crime, possession of a firearm as a minor, illegal possession of a regulated firearm, handgun on his person, discharging a firearm, and illegally possessing ammunition for an incident that occurred on Dec. 17, 2021
