The prosecution dropped all charges against a Baltimore man on June 6 after the victim refused to testify against him before Baltimore City Circuit Court Judge Hope Tipton.
Kondwani Martin, 43, was charged with first- and second-degree assault, firearm use in a felony violent crime, illegal possession of a regulated firearm, having a handgun on his person and having a loaded handgun on his person for an incident that occurred on the 1600 block of Fleet Street.
Martin’s attorney, John Cox, told Baltimore Witness if the victim invoked his right against self-incrimination, then the prosecution would not have a case.
Ultimately, the victim decided not take the stand, Without that testimony, there was apparently not enough evidence to prosecute Martin.
On Feb. 11, 1998, Martin was convicted of a second-degree assault, prohibiting him from possessing a firearm.
According to documents from the District Court of Maryland, on Sept. 3, 2023, Baltimore Police Department officers responded to a shooting call, where the victim suffered from a gunshot wound on his left arm.
The victim allegedly identified Martin as the shooter.
