On Oct. 19, Baltimore City Circuit Court Judge Melissa M Phinn set trial for a Baltimore man charged with murder.
Marquis Poteat is charged with two counts of first-degree murder, use of a firearm in a felony violent crime, and carrying a handgun on his person in connection to the murder of Frankye Duckett on Jan. 29, 2021.
According to a news release, 33-year-old Poteat allegedly shot the victim who worked as an MTA driver. The victim was dropping off a passenger on the 4400 block of Moravia. It is unknown what the motive was behind the shooting. The defendant was arrested in South Carolina by the regional task force and later was extradited to Baltimore.
The prosecution offered the defendant a plea of life in prison for first-degree murder, and a concurrent sentence of 20 years, suspending all but five years for use of a firearm in a felony violent crime.
The defendant and defense counsel rejected this offer.
Judge Phinn scheduled Poteat’s trial date for May 1, 2023, before Baltimore City Circuit Court Judge John A. Howard.
