Dana Davenport, 30, appeared in court for opening statements in his murder trial before Baltimore City Circuit Court Judge Jennifer B. Schiffer on Jan. 17.

Davenport is charged with two counts of first-degree murder, firearm use in a felony violent crime, having a handgun in the vehicle, carrying a handgun on his person and illegal possession of a regulated firearm.

According to the prosecution, Davenport was sitting in the passenger side of a vehicle, while another person was seated in the back seat of the car. That person will testify Davenport fatally shot Tyrone Walker, who was driving the two men to their destination.

The assistant state’s attorney added there was no doubt that the defendant was at the 200 block of South Loudon Avenue crime scene, pointing out there was a used container there allegedly with the defendant’s DNA on it. Detectives also say they found Davenport’s fingerprints on the passenger side of the car.

In response, Davenport’s defense attorney Marci Johnson said all the prosecution’s evidence only shows the defendant was indeed with those people but not that he was involved in the shooting. Johnson’s theory of the case was that Davenport left the car before the shooting happened.

Update: The jury delivered a guilty verdict for Davenport on Jan. 21.
