In a trial that started on Dec. 12, Keith Luckey, 40, is charged with second-degree murder, firearm use in a felony violent crime, the use of an assault weapon with a magazine and reckless endangerment in connection to an incident on Nov. 7, 2022.

The prosecutor said Luckey, an on-duty security officer, killed Kevin Abel Torres Guerrero out of spite because of an altercation they had in a Highlandtown bar.

According to documents from the District Court of Maryland, on Nov. 7, 2022, Baltimore Police Department officers heard multiple gunshot sounds coming from outside the Chris T Bar on the 4000 block of East Lombard Street.

Upon arrival, they found 35-year-old Guerrero lying on the ground with a gunshot wound to his chest. He was transported to Johns Hopkins Bayview Hospital and declared dead.

Video footage revealed Luckey and Guerrero allegedly getting into an altercation outside of the bar. Luckey was seen spraying a chemical agent at Guerrero, which the police later identified as mace. Then Guerrero picked up a brick and threw it at Luckey.

He initially retreated, dodging the brick. After the victim picked up another brick, the defendant allegedly pulled out his gun and shot Guerrero.   The prosecutor said the defendant had two loaded magazines.

Defense attorney Lawrence Rosenberg said given the circumstances the prosecution can’t prove that Luckey fired his gun in anger.

Baltimore City Circuit Court Judge Myshala E. Middleton  is presiding over the trial.
