Judge Postpones Sentencing for Murder Defendant Accused of Violating Probation

“I want it straight,” demanded Baltimore City Circuit Court Judge Lynn Stewart Mays on Nov. 28. “I want dates.”

Stand-in defense counsel for Larry McMillian told the judge that he would “look into” a pending sentencing date his client faced in another state. 

McMillian, 37, was released from a Maryland prison in February after serving a 15 year sentence in connection with a 2006 homicide. 

He was originally charged with first-degree murder, but accepted a plea deal of 30 years, suspending 15, with three years of probation for the two lesser charges of second-degree murder and having a handgun on his person in 2007. 

McMillian received a drug charge in Pennsylvania in July of this year, which prompted his release in Maryland for violating his probation. However, the defendant told the court that he didn’t know when his sentencing was.

He was facing two counts of violating his probation because of the Pennsylvania offense, for which he pled guilty. Defense counsel acknowledged that McMillian, who was not in custody, arrived in court on-time and of his own accord. 

Judge Mays ordered both the prosecutor and defense counsel to gather more information about McMillian’s pending charges. 

McMillian’s hearing was rescheduled for Dec. 7, 2022.
