Homicide Defendant’s Trial Date Set in July

A homicide defendant, who is slated to get a private attorney, was scheduled for trial for July 7.

Kyree Davis, 22, is charged with first-degree murder, firearm use during a felony-violent crime, loaded handgun on person, carry/wear handgun on person for allegedly shooting 22 year-old Shamyar Austin on the 4800 block of Bayonne Avenue on April 11.

Davis’ current representation is public defender Todd Oppenheim.

On the defendant’s behalf, Oppenheim rejected a plea offer Dec. 7 for Life, suspending all but 50 years with five year on probation for first-degree murder.

During the hearing Tuesday, Judge Melissa Phinn was notified that Davis’ family hired a private attorney, Donald Wright.

The prosecution said, Wright told them, by email, that an available trial date would be on July 7, 2022, which is after the defendant’s Hicks’ date on Dec. 5.

Judge Melissa Phinn scheduled the five-day trial from July 7-13. Judge Dana Middleton will preside over the trial.
