Defendant Accused of Attempting to Murder his Girlfriend’s Daughter Unable to Appear in Court

An attempted murder defendant in protective custody was unable to appear before Baltimore City Circuit Court Judge Melissa M. Phinn to accept or decline a plea offer on April 19.

Andre Davis, 36, is facing two counts of attempted first-degree murder, attempted first-degree murder of a minor, two counts of attempted second-degree murder, attempted second-degree murder of a minor, three counts of first-degree assault, four counts of second-degree assault, and two counts of reckless endangerment, use of a firearm during a violent crime, having a handgun on his person, discharging firearms, and malicious destruction of property of more than $1,000 in connection to an incident on May 31, 2020. 

Davis’ defense attorney, Jonathon Kerr, told Judge Phinn on Tuesday that his client is in protective custody and unable to appear in court.

The defendant was offered 10 years suspending all but five years with three years on probation for first-degree assault, along with 5 years for reckless endangerment. All charges are set to run concurrently. 

Under the deal, Davis must also stay away from the victim, seek drug and alcohol treatment, if necessary, and register as a gun offender. 

According to court documents, police responded to a call for an aggravated assault on the 2800 block of Lake Avenue. The victim told police that Davis, her mother’s boyfriend at the time, began arguing with her. As the defendant became more agitated.

When the victim attempted to leave and get in her vehicle with her 1-year-old son inside, Davis allegedly started shooting at her with a semi-automatic handgun. 

Davis is scheduled to appear in court to accept or decline the plea offer on April 25.
