Counsel Delivers Opening Statements for Attempted Murder Defendant

The trial of a 22-year-old defendant began on Dec. 10 before Baltimore City Circuit Court Judge Martin P. Welch with conflicting views about the evidence in the case.

Malik Height, 22, is charged with two counts each of attempted first- and second-degree murder, first-degree assault and reckless endangerment, as well as attempted armed carjacking, attempted carjacking, attempted armed robbery, robbery, firearm use in a felony violent crime, having a handgun on his person, and one other weapons charge. 

During the opening statement, counsel debated whether Height was in possession of a firearm during the incident.

The prosecution alleged that Height fled from police and discarded a firearm at a nearby residence that was later recovered by officers. The event was captured on a surveillance camera.

Height’s attorney, James Sweeting III, argued about a lack of physical evidence, such as fingerprints and DNA, that could link Height to the firearm. 

Sweeting also mentioned that none of the officers saw Height discard the gun, and that the recovered CCTV footage is too brief to aid the investigation. 

The trial is set to continue on Dec. 11.
