Motion to Dismiss Pending in Re-indicted Attempted Murder Case

An attempted murder case that was re-indicted was scheduled for a motion to dismiss hearing next month in a June 8 proceeding before Baltimore City Court Judge Melissa K. Copeland.

Donte Mack, 23, is charged with attempted murder, assault, reckless endangerment, and multiple firearm violations resulting from a shooting that occurred on the 2300 block of W. North Avenue in November of 2024. 

Mack’s attorney, Christopher O’Meara, has scheduled a motion to dismiss based on speedy trial violation. Maryland law states that criminal trials must start within 180 days of a defendant’s or defense attorney’s initial appearance in circuit court, subject to certain exceptions. 

Mack has been waiting for his trial since his arrest on Jan. 15, 2025 and his initial court appearance on March 13, 2025. His trial was originally scheduled for Feb. 3 of this year, but the case was dismissed after the prosecution said it was an “exercise of the state’s discretion.” The case was then re-indicted..

During the pretrial conference, the prosecutor stated the parties had engaged in plea negotiations but there is no offer yet.

A hearing on Mack’s motion to dismiss is scheduled on the morning of July 8. 

If the case proceeds, a backup trial date has been scheduled for Aug. 11. The trial is scheduled to last approximately three days.
