Woman Charged with Attempted Murder Accepts Plea in 2022 Maryland Avenue Non-Fatal Shooting Case

A woman accepted a plea in the case of a non-fatal shooting on April 3 before Judge Erik Atlas in Baltimore City Circuit Court. 

An assistant state’s attorney offered defendant Destiny Nickelson 30 years, suspending all but seven years for attempted second-degree murder and 20 years, suspending all but five years without the possibility of parole and 5 years of probation for conspiracy to use a firearm in a felony violent crime. 

The total plea was 50 years, suspending all but 12 with five years of supervised probation. Nickelson is also required to complete a drug screening and treatment and have no contact with the victim. 

Nickelson’s defense attorney Bradley MacFee is pushing the court to declare her not responsible at the time of the crime due to mental illness. 

According to MacFee, Nickelson, 30, was receiving mental health treatment from a private psychiatrist and was prescribed medication for her health issues. 

Macfee said Nickelson took more medication than what was prescribed on the day of the crime. 

Judge Atlas said he would consider the motion for a mental health screening.

As stated on the Maryland Judiciary website, Nickelson was charged with attempted first-degree murder, con-murder first-degree, attempted armed robbery, armed robbery-con, first-degree assault, con-assault first-degree, second- degree assault, con-assault second degree, firearm use in a felony violent crime, having a handgun on her person, con-having a handgun on her person, having a handgun in her vehicle, having a handgun in her vehicle on a public road, having a loaded handgun in her vehicle, con-having a loaded handgun in her vehicle, and discharging a firearm. 

According to court documents the incident occurred on June 4, 2022 on the 200 block of Maryland Avenue. CCTV cameras captured Nickelson and his co-defendant Deaira Roary arguing with the victim. 

The victim told police that he was almost stabbed and that he heard gunshots. 

A 9 mm loaded magazine was found under Nickelson’s seat in the Nissan Sinatra used to flee the scene. 

Nickelson’s sentencing is scheduled for Aug. 4.
