The retrial of Dionte Cain continued on June 3 before Baltimore City Circuit Court Judge Lawrence P. Fletcher-Hill, with prosecutors presenting their case in a 2024 armed robbery in North Baltimore.
Cain, 32, faces charges including attempted murder, armed robbery, first-degree assault, reckless endangerment, multiple firearm offenses, and several counts of conspiracy. Investigators believe he and his co-defendant, 29-year-old Darnell Johnson, shot a 76-year-old man on the morning of April 2, 2024, after attempting to rob him in a Family Dollar parking lot on the 5300 block of York Road.
Last April, Johnson pleaded guilty to conspiracy to commit armed robbery, acting as an accessory after the fact, and having a loaded handgun in a vehicle. After testifying against Cain last October, he was released on his own recognizance pending sentencing. On the stand, he had told the court Cain allegedly confessed to him that he shot someone.
The court ultimately declared a mistrial in Cain’s case after jurors failed to reach a unanimous verdict on his charges
In the current proceeding, a Baltimore Police Department (BPD) officer who responded to the scene described body-worn camera footage that showed emergency personnel treating the victim, who was found inside a blue pickup truck.
Jurors also heard a 911 call and saw video of officers securing the scene, which included the victim’s vehicle, the surrounding area, and injuries sustained during the incident. Investigators later searched and processed the vehicle for evidence.
During cross-examination, defense attorney Natalie Finegar questioned evidence collection procedures and the preservation of the crime scene.
Prosecutors later called a detective assigned to the investigation, who testified about efforts to obtain surveillance footage from nearby businesses.
The trial remains ongoing and is scheduled to continue on June 4.
