Prosecutor Dismisses Attempted Murder Charges in 2022 Case

During what was expected to be the first day of trial a defense attorney waived his client’s right to appear because the prosecutor planned to enter a nolle pros for all counts.

On Aug. 8, defense attorney Roland Harris IV appeared before Baltimore City Circuit Court Judge M. Brooke Murdock without his client, Tavion Thomas. He waived the 23-year-old defendant’s appearance, but Judge Murdock told him that was unnecessary.

Judge Murdock called both attorneys to the bench and had a brief conversation with them. When they finished, the prosecutor told Judge Murdock that she had a preliminary motion.

The prosecutor entered a nolle pros for all counts, dismissing the charges against Thomas.

Thomas was charged with attempted first- and second-degree murder, first- and second-degree assault, reckless endangerment, firearm use in a felony violent crime, having a handgun on his person, discharging firearms, illegal possession of ammunition, firearm possession with a felony conviction and illegal possession of a regulated firearm in connection to a Sept. 5, 2022 incident.

Officers were notified that Thomas had an arrest warrant issued for him. Since they had had previous interaction with him before, they canvassed the areas they believed he would be. They found him on the 3200 block of Belair Road, an area known to be an open-air drug market. Thomas was arrested without incident. Officers located a handgun and what they believed to be marijuana on him.
