A Baltimore City Circuit Court judge agreed to postpone the jury trial of a non-fatal shooting defendant on Oct. 3 until December to allow the prosecution to review recently-obtained evidence.
The 33-year-old defendant is charged with six weapons charges, including firearm possession with a felony conviction, illegal possession of a firearm, carry or wear handgun on person, handgun in vehicle, discharging firearms, reckless endangerment and illegal possession of ammo for his alleged involvement in an incident that occurred on Feb. 22.
During Monday’s proceedings, the prosecutor informed Judge Melissa Phinn that she recently received “additional discoverable materials” from officers with the Baltimore Police Department and needed time to review the extensive footage, which she received last week.
The defendant’s defense attorney, T. Wray McCurdy, noted that his client, who is charged with six weapons charges and reckless endangerment, currently has another case underway in Harford County that coincides with this case. The case in Harford County is scheduled in the coming weeks, he said, which would require the Baltimore City case be postponed to a later date.
Judge Phinn agreed to push the defendant’s trial to Dec. 1, but said she will not postpone the case further should it be impacted by the case in Harford County.
