Plea Agreement Reached for Co-Defendant in Gwynns Falls Parkway Attempted Murder

On Dec. 6, one of the two defendants involved in a 2022 domestic dispute accepted a plea deal from the prosecution.     

Alvin Cunningham, 36, was charged with two counts of attempted first-degree murder, two counts of attempted second-degree murder, two counts of first-degree assault, two counts of second-degree assault, carrying a handgun on his person, carrying a loaded handgun on his person, having a handgun in his vehicle, having a loaded handgun in his vehicle, possession of a deadly weapon with intent to injure, firearm use in a felony violent crime, possession of firearms in a drug offense, illegal possession of ammunition and stealing and/or selling a stolen pistol in connection to an incident on Feb. 15, 2022.

Cunningham and his codefendant, Pierrerea Henry, 29, share the same charges. Henry is also the mother of Cunningham’s youngest child. According to Baltimore Witness, Henry is expected to appear in court on Jan. 10, 2024.  

Baltimore City Circuit Court Judge Lawrence R. Daniels began by hearing the prosecution’s plea offer. For the charge of firearm use in felony violent crime, the prosecution offered 10 years, suspending all but five years, with no possibility of parole, and three years of supervised probation to follow.  

Defense attorney Donald C. Wright was in agreement with the plea offer, save for the date when the defendant would be taken into custody. He requested a later date  so that Cunningham could not only spend the holidays with his children, but also celebrate his daughter’s ninth birthday. 

“It’s been a long, stressful time… I just want to see my kids for the holidays and then do what I got to do to put this behind me,” Cunningham said to Judge Daniels.

Wright added that Cunningham suffers from serious mental and physical issues, having been a victim of violent crime himself.

 “Mr. Cunningham is here to accept responsibility,” Wright stated.

Judge Daniels accepted the plea and found Cunningham guilty of firearm use in a felony violent crime. He sentenced Daniels to 10 years, suspending all but five years, without the possibility of parole, and three years of supervised probation upon release. Cunningham also must register as a gun offender and not have any contact with the victims in the case.   

Moreover, Judge Daniels wants to consider Cunningham for a dual-diagnosis program at the Patuxent Institute so he could receive treatment while he serves his time. Judge Daniels also set Cunningham to appear at the Sheriff’s office on Dec. 27, allowing him to spend the holiday season with his family.  

According to documents from the District Court of Maryland, on Feb. 15, 2022, Baltimore Police Department officers responded to reports of a shooting at 3300 Gwynns Falls Parkway.

An altercation between Cunningham, Henry and the two victims had occurred over a custody dispute. After the fight turned physical, one of the victims tried to leave. Then, Henry allegedly said, “Just kill him,” and Cunningham shot at the victim who was uninjured. The pair of suspects was later identified by the victims and were arrested on Feb. 17.
