Murder Defendant Receives Trial Date

A man charged with attempted first-degree murder received a trial date during reception court on Oct. 25 at Baltimore City Circuity Court. 

Tracy Cecil Davis Jr., 27, is charged in connection to an incident on Feb. 17. Along with attempted first-degree murder, he is also charged with second-degree murder, first and second-degree assault, reckless endangerment, and use of a deadly weapon with the intent to injure. 

On Monday, the prosecution relayed a plea of 25 years with eight years of probation after release and no contact with the victim.

Judge Melissa M. Phinn asked defense attorney Dalia Weintraub if she had reviewed the offer with Davis. She said that the plea was not shared with the defendant because she received additional discovery that she has to review. 

Shortly after, Davis refused to waive his right to a speedy trial. Under Maryland law, a defendant has the right to be tried by their Hicks’ date, or within 180 days of their first appearance in court.

Judge Phinn found cause to postpone his case because Weintraub would not be ready for trial prior to the Hicks’ date.

A trial is set for March 9, 2022.
