A non-fatal shooting defendant was scheduled for a trial date later in the summer after rejecting a plea deal for 45 years in prison during a May 13 hearing.

Darrien Gaither is charged with 22 counts, including first and second-degree attempted murder, first and second-degree assault, among other firearm related charges for allegedly shooting a 50-year-old male on Dec. 29, 2023, on the 2400 block of Liberty Heights Avenue at the  Mondawmin Mall.

Baltimore City Circuit Court Judge Melissa Copeland set the trial to begin on Aug. 20 before Baltimore City Circuit Court Judge Ronald Silkworth.

Even though a trial date has been set, Gaither’s defense attorney Matthew Connell said he could not move forward because he was still missing relevant evidence from the prosecution.

Connell said he received evidence from the prosecution, but has not received a document that provides him with information on searches, testing results, witnesses, or any statements his client may have made.

Connell also said he received 90 videos from the prosecution, but was unable to open 10 of them due to formatting issues.

The prosecution told Judge Copeland that the defense would receive a document containing all relevant information later in the day.

The judge gave the prosecution the time to get the document to the defense, but said it should have been provided earlier since the case was indicted in February.
