On Dec. 14, Baltimore City Circuit Court Judge Melissa M. Phinn scheduled a 20-year-old attempted murder defendant’s trial for spring 2024.
Tyresse Flemming, 19, is charged with attempted first- and second-degree murder, first- and second-degree assault, reckless endangerment, firearm possession with a felony conviction, illegal possession of a regulated firearm, illegal possession of ammunition, firearm use in a felony violent crime, having a handgun on his person and firing a gun in Baltimore City in connection to a July 20 incident.
The prosecution did not have a plea agreement prepared for today’s hearing, which she admitted was “an oversight.”
Defense attorney John Cox had only received the evidence against his client and told Flemming that he would meet with him next week.
Judge Phinn scheduled Flemming’s three-day trial to begin on Feb. 26, 2024, before Judge Philip S. Jackson.
According to documents from the District Court of Maryland, Baltimore Police Department officers responded to the 5000 block of East Preston Street, where they found the victim with a gunshot wound to his shoulder. The victim said he confronted his stepdaughter’s boyfriend, who he later identified as Flemming, about a previous assault on his stepdaughter. The victim claimed that he punched Flemming and he shot him in response.
