Judge Places Cherry Hill Road Defendant’s Case on Stet Docket Until Further Notice

On July 20, before Baltimore City Circuit Court Judge Althea M. Handy, a defendant’s case was placed on stet with no future date set for trial.

Defendant Michael Brandon, who is represented by Robert D. Cole, Jr., is facing charges including first- and second- degree attempted murder, first- and second-degree assault , reckless endangerment and various firearm charges.

Brandon’s defense attorney waived the 22-year-old defendant’s appearance for Thursday’s hearing.

The prosecution was clear that they were not planning on reopening the case, a matter that was of great concern to the defense. Difficulties with witnesses and delaying the trial were mentioned, however it was made clear that these were not the reasons behind the presecutor’s decision to move the case to the stet docket. 

Cole told Judge Handy that he had already advised Brandon of the meaning behind his case being placed on the stet docket, as well as the fact that he would be waiving his right to a speedy trial. Once all matters had been explained, Cole accepted the stet placement for Brandon.  

According to the statement of charges, on April 19, 2022, around 10:45 a.m., Baltimore Police Department officers responded to the 700 block of Cherry Hill Road for reports of a shooting. Upon arrival, the police identified a black male victim suffering from multiple gunshot wounds. The victim was transported to the University of Maryland Shock Trauma Center, where he received treatment for his wounds. 

The incident occurred inside and outside of the vestibule of Happy Family Mart and was captured on video footage at the store. The footage showed a suspect exiting a vehicle and then opening fire at the victim.

Detectives were able to lift fingerprints from this door that were later confirmed to match the defendant. Brandon also matched the height, weight and build of the individual seen in the surveillance footage.
