Judge Assigns Trial Date to Defendant in Fremont Avenue Non-Fatal Shooting Case

On March 14, an attempted murder defendant rejected a plea offer before Baltimore City Circuit Court Judge Melissa M.Phinn

Kinard Smith, represented by an attorney standing in for Brandon Mead, rejected a plea of life, suspending all but 20 years, the first five years without the possibility of parole, along with five years of supervised probation for three counts of attempted first-degree murder and the use of a firearm in a felony violent crime in connection to an incident that occurred on Sept. 21, 2022. The defendant would have also been ordered to have no contact with the victim and actively participate in an abuse program. 

According to the Baltimore Police Department (BPD), on the day of the incident, police were called to the 1300 block of North Fremont Avenue. When they arrived, they found an 18-year-old suffering from a gunshot wound to the leg. Smith was arrested five days later. 

Smith, 30, is charged with three counts each of attempted first and second-degree murder, three counts each of first and second-degree assault, use of a firearm in a felony violent crime, having a handgun on his person, having a handgun in a vehicle, having a loaded handgun in a vehicle and having a loaded handgun on his person.

If the plea offer was accepted, the prosecution stated that they would nolle pros Smith’s second case, in which he is charged with having a handgun on his person, having a loaded handgun on his person, having a handgun in a vehicle, having a loaded handgun in a vehicle and resisting arrest in connection to an incident that occurred on Sept. 26, 2022. 

Judge Phinn set the defendant’s trial to begin on July 11, with Baltimore City Circuit Court Judge Dana M. Middleton presiding. It is expected to last four days.
