A homicide defendant’s case was dismissed on Jan. 9 after a Baltimore City Circuit Court judge denied the prosecution’s second postponement request to locate a witness.
Martinez Armstrong, 31, was initially charged with the fatal shooting of Michael Montgomery on June 11, 2020, on the 3700 block of Gelston Avenue. Police arrested Armstrong a year later.
On Monday, the prosecutor asked Judge Jeannie Hong to postpone the case to find a witness important to the case. Given the case had been previously postponed, Judge Hong denied the request and granted the prosecution’s request to dismiss the case.
Armstrong was represented by defense attorney Deborah Warner-Dennis.
