Defense Argues for Attempted Homicide Defendant’s Release Due to Medical Issues

Defense counsel for a Baltimore man accused of a carjacking and attempted murder argued her client’s release on private home detention during bail review on March 11, citing the defendant’s ongoing medical issues.

Gary Weldon, 34, is charged with first and second-degree attempted murder, carjacking and armed carjacking, as well as several other charges in connection to an incident on July 25, 2021, on the 3700 block of Nortonia Road. CBS Baltimore previously reported that police were called to the area shortly before midnight and found a 34-year-old man suffering from apparent gunshot wounds.

Weldon’s last bail review was postponed for medical reasons.

On Friday, defense attorney Judit Otvos asked Baltimore City Circuit Court Judge Charles J. Peters for Weldon’s release on private home detention given the seriousness of his medical condition. Otvos said Weldon had craniotomy last November and is at a high risk of infection.

Otvos also said the victim in the case identified someone else in a photo array, and her client has been incarcerated since July 2021 and isn’t scheduled for trial until September.

The prosecution then informed the court that Weldon was found in the stolen vehicle days after the incident.

Given the evidence presented, Judge Peters denied Weldon’s release.

Weldon is set to appear in court on Sept. 19, according to the Maryland Judiciary website.
