Defense Alleges Victim ‘Fabricated Story’ About Accused Shooter

Defense counsel argued that the mother of his client’s children fabricated a story about the defendant firing a gun into her home after he attempted to drop off Christmas presents for his children.

During a bail review hearing on May 6, defense attorney Stuart Schadt appeared in court to represent the 32-year-old defendant who is charged with first and second-degree assault, fourth-degree burglary, reckless endangerment, malicious destruction of property valued at $1,000, and discharging firearms for an incident on Jan. 17.

Schadt explained that his client bought Christmas presents for his three children long before the holiday and repeatedly tried to contact their mother to schedule a time to drop off the presents and see his children. After several unsuccessful attempts, the defendant then went to her home and knocked on the door, but no one answered.

The defendant was adamant that no handgun was involved, said the defense attorney, who requested his client be released on his own recognizance or home detention.

A state prosecutor countered that the defendant allegedly fired a handgun into the house around 9 a.m. with the mother and three children inside.

According to the state and pre-trial services, the defendant has three prior convictions, including first-degree assault in 2016, drug possession in 2011, and drug distribution in 2008.

Based on the arguments presented, Baltimore City Circuit Court Judge Cynthia H. Jones denied bail.

The defendant is scheduled to appear in reception court on Oct. 6.
