Convicted Murder Defendant’s Counsel and State Agree to Mutual Postponement

On Sept. 27, a Baltimore man charged with first-degree murder had his collateral hearing postponed before Judge Kendra Y. Ausby.

Andre Chapel was charged with first-degree murder and two counts of violation of probation while being convicted on two additional charges of second-degree murder, and the use of a handgun in committing a crime in connection to an incident on March 8, 1999. 

That same month, Chapel, 41, was sentenced to 30 years, suspending all but 15 years with five years of supervised probation for second-degree murder. The defendant was also sentenced to 20 years, suspending all but 20 years with five years of supervised probation for use of a handgun in committing a crime which will run consecutively to the first sentence.

The defense and state prosecutor were both in agreement that this case was still under investigation and requested a postponement to the hearing. 

Judge Ausby granted this request and set the hearing date for Dec. 19.
