A Baltimore man convicted of first-degree murder in 1999 had his hearing postponed on Jan. 17 before Baltimore City Circuit Court Judge Gregory Sampson.
Judge Sampson informed the court that 45-years-old Donte Spivey‘s hearing was postponed due to the defendant having three pending cases before Judge Melissa Phinn. The judge stated that those hearings need to be taken care of first before the defendant can be heard before him.
In June 1999, Spivey, who was 21 at the time, was convicted of first-degree murder and having a handgun in the use of committing crime in connection to the murder of 18-year-old Dameon Travon Burrell in 1995 alongside his co-defendant Donnell Harris.
Spivey was sentenced to life for first-degree murder and a concurrent 20 years for the use of a handgun in commission of a crime of violence.
According to the Baltimore Sun, on the day of the incident officers were called to the 300 block of Hawthorne Road for reports of several shots being fired.
Harris, 21-years-old at the time, was convicted of the murder of the 17-year-old victim sentencing him to life in prison for first-degree murder and a concurrent 20 years for the use of a handgun in commission of a crime of violence.
Spivey’s next hearing is scheduled for Sept. 13.
