Attempted Murder Defendant Wins Trial Postponement

An attempted murder defendant went before Baltimore City Circuit Court Judge Melissa K. Copeland  in order to reschedule his trial on June 26. 

Daquann Toney, 27, is charged with attempted first-degree murder, attempted second-degree murder, first-degree assault, second-degree assault, reckless endangerment, firearm use in a felony violent crime, firearm possession with a felony conviction, illegal possession of a regulated firearm, illegal possession of ammunition, having a handgun within 100 yards of the public, carrying a loaded handgun and firing a gun in Baltimore City in relation to an incident that occurred Aug. 13, 2023. 

Toney’s defense attorney, Andrea Jaskulsky, indicated he will summon two witnesses and Jaskulsky needs time to interview them and prepare for trial. The stand-in prosecutor did not object because the assigned prosecutor was engaged in another trial.

The new trial date was scheduled for Oct. 7 in front of Judge John A. Howard. 

According to documents from the District Court of Maryland, on Aug. 13, 2023, Baltimore Police Department (BPD) officers reported to a Food Market located on the 1600 block of Wilkens Avenue, where there was a report of a non-fatal shooting. The victim was wounded in the abdomen and was transported to Saint Agnes Hospital for treatment. Investigators identified Toney as the suspect through surveillance footage and witness statements.
