Acquitted: Double Attempted Murder Trial Ends

A jury found 34-year-old Andre Brisbon not guilty of all charges on March 7 before Baltimore City Circuit Court Judge Althea M. Handy.

According to previous trial coverage, the parties debated whether results from allegedly contaminated physical evidence were reliable. Multiple people had touched bullet casings from the firearm on which Brisbon’s DNA was allegedly found, and its testing was delayed for several days.

The jury was evidently persuaded by defense attorney David Shapiro’s suggestion that one of the witnesses was led by the prosecutor to unethically identify Brisbon as the suspect. 

Brisbon was implicated in a road rage incident that occurred on April 9, 2023. At trial, the prosecutor alleged that the driver of a Chevy Malibu crashed into Brisbon’s Volkswagen Passat on the 3100 block of South Hanover Street.

The driver of the Chevy Malibu fled the scene, later explaining to law enforcement that they accidentally hit Brisbon’s car but drove away because he began shooting at them. There was dispute about whether a gun located in a nearby bush belonged to Brisbon.

Before acquittal, the defendant faced two counts of attempted second-degree murder, two counts of first-degree assault and three counts of possessing a firearm. He was also charged with reckless endangerment, firearm use in a felony violent crime, discharging a firearm, illegal possession of ammunition and having a handgun on his person.
