Trial of East Lombard Street Homicide Reset

On Dec. 6, the trial of 40-year-old second-degree homicide defendant Keith Mario Luckey was rescheduled by Baltimore City Circuit Court Judge Melissa M. Phinn

Luckey is charged with second-degree murder, firearm use in a felony violent crime, the use of an assault weapon with a magazine and reckless endangerment in connection to an incident on Nov. 7, 2022.

According to Luckey’s counsel, Lawrence Rosenberg, the trial was supposed to begin Wednesday before Judge Melissa K. Copeland. He stated that Judge Copeland requested off for today’s date, leaving no trial judge. The case was moved to reception court, where Judge Phinn could reschedule. 

The stand-in prosecutor explained the prosecutor requested a postponement on the basis that one of his witnesses was unavailable, but he would be ready for trial on Dec. 11. Rosenberg explained that he, his client and his witnesses were all ready for trial. 

Judge Phinn and Rosenberg agreed to start the trial on Dec.11 because it has been postponed too many times. 

Judge Phinn continued the hearing until Dec. 8 to confirm that the prosecutor and his witnesses will be ready.

According to documents from the District Court of Maryland, on Nov. 7, 2022, Baltimore Police Department officers heard multiple gunshot wounds coming from outside the Chris T Bar on the 4000 block of East Lombard Street. Upon arrival, they found 35-year-old Kevin Abel Torres Guerrero lying on the ground with a gunshot wound to his chest. He was transported to Johns Hopkins Bayview Hospital, and declared dead.

Video footage revealed Luckey and Guerrero allegedly getting into an altercation outside of the bar. Luckey was seen spraying a chemical agent at Guerrero, which the police later identified as mace. After being sprayed, Guerrero picked up a brick and threw it at Luckey. He initially retreated, dodging the brick thrown at him. When the victim was seen picking up another brick, the defendant allegedly stopped, pulled out his gun and shot Guerrero in the chest.
