With seven prior convictions, a 27-year-old man was charged with homicide and denied bail for the second time on March 18 before Baltimore City Circuit Court Judge Phillip S. Jackson.
Davon Douglass is charged with two counts of first-degree murder, use of a firearm during a violent crime and possession of a firearm with a felony conviction in connection to an incident on Oct. 27, 2019.
During a bail hearing on Friday, Judge Jackson listened as the defendant’s defense attorney, Benjamin Charlton, questioned the reliability of the only witness to the murder.
He said police couldn’t find the witness, whom the prosecution says identified Douglas, for a year. The witness was not located until he arrested a year.
Based on the questionable reliability of the witness, Charlton requested that his client be released on home detention. If released, the defendant would live with his mother who he helps take care of along with his fiancée and their two kids. Charleston also said his client previously had a bail review for another case that was nolle pros in September 2021.
The prosecutor informed the court that on Oct. 27 2019, around 4 p.m. the victim was shot nine times in his back while standing in his backyard. There were two shooters but three guns were involved in the shooting with two different suspects. She also said that the victim was killed in an act of retaliation.
In addition, the prosecutor added that initially the witness did not say anything for four months because he was afraid. She continued by saying that at first the police were unable to locate the witness but once they did, the witness was consistent with his identification of the defendant.
Douglas has seven prior convictions, including possession of narcotics with intent to distribute with a sentence of three years suspending all but two years, seven months, and 14 days with three years on supervised probation on June 28, 2013; three counts of violation of probation with a sentence of six months; and second-degree assault with a sentence of two days on Aug. 12, 2014; conspiracy to distribute narcotics with a sentence of seven years suspending all but six years, 11 months, and 28 days with one year and six months of supervised probation on Nov. 27, 2018.
Douglass was released on bail on Aug. 5, 2020, for $20,000.
According to WMAR News, on Oct. 27, 2019, around 4:51 p.m., 30-year-old Kris McCoy was shot on the 6100 block of Boston Street.
The medics took the victim to John Hopkins Bayview hospital, where he was pronounced dead shortly after.
