Counsel to Argue Dismissal of Attempted Murder Case in Early 2022

A Baltimore City Circuit Court judge will hear defense counsel’s motion to dismiss charges in an attempted murder case against a 31-year-old Baltimore man early next year.

Shelton Price is currently facing four counts each of attempted first and second-degree murder, first and second-degree assault, and reckless endangerment in addition to single counts of firearm use in a felony violent crime, having a handgun on his person, having a loaded handgun on his person, and discharging firearms.

The incident occurred on Oct. 1, 2020, and Price rejected a plea offer in July.

On Dec. 20, nearly five months after the defendant’s last court appearance, defense attorney Bradley MacFee informed Judge Melissa M. Phinn that he filed a motion to dismiss the charges against his client, which will require witnesses. MacFee said the probable cause that led to the motion was that a Baltimore Police Department officer said he knew Price at the time of his arrest because he previously arrested him.

However, MacFee said, that was later found to be false and, therefore, was an unlawful arrest.

The prosecution said they need to speak with the officer and hope to have a response to the motion by Jan. 1, 2022.

Judge Phinn scheduled counsel to argue the motion on Feb. 7, 2022.
