15-Year-Old Homicide Defendant Denied Bail for Third Time

A Baltimore teen was denied bail a third time on Oct. 14 at Baltimore City Circuit Court.

Damonyae Malone is being charged as an adult with first-degree-murder and firearm use in a violent crime for allegedly shooting 15-year-old Jaileel Jones in the head after an argument on the 5100 block of Chalgrove Avenue on March 4.

Defense attorney Sasha Garcon waived Malones’ presence during Thursday’s hearing. 

Garcon said that because Malone is now 16 years of age, he is eligible for a transfer to adult court; however, they are still waiting on the juvenile reports.

Garcon asked the court to consider releasing Malone on private home detention pending the outcome of his case given his young age. Additionally, Garcon told the court that the defendant was receiving weekly therapy prior to his arrest.

The prosecution had no objection to letting the defendant continue his weekly therapy while detained, but given the seriousness of the allegations and the fact that this was his third bail review, the prosecutor objected to the request for Malone to be released.

The defendant is currently scheduled for a motions hearing on Oct. 21, and a juvenile transfer hearing to be discussed in reception court on Nov. 30.
