A Baltimore City prosecutor dismissed an attempted murder case against North Baltimore resident Eric Emanual Nelson Jr. on Oct. 22 after multiple unsuccessful attempts to find two witnesses necessary for trial.
Counsel selected the jury for Nelson’s trial on Oct. 21 and were prepared to begin arguments Tuesday when the prosecutor informed Baltimore City Circuit Court Judge Dana M. Middleton of its predicament. The prosecutor said sheriff’s deputies were unable to find the victim and another witness, only one of which was needed for the prosecution’s case.
The prosecution entered a nolle prosequi, or dismissal, of the charges, including attempted first and second-degree murder, first-degree assault, firearm use in a felony or violent crime, firearm possession with a felony conviction, reckless endangerment, having a handgun on his person, having a loaded handgun on his person, firing a gun in Baltimore City and illegal possession of ammunition.
Defense attorney James Sweeting III informed Nelson that the prosecution can chose to re-indict him for the incident at a later date.
The 31-year-old defendant was accused of shooting a 54-year-old man on the 5300 block of Ready Avenue in the Woodbourne-McCabe neighborhood on Dec. 20, 2023. According to court documents, the victim walked into Good Samaritan Hospital’s emergency room just after 8 p.m. and was taken to Shock Trauma for treatment of a gunshot wound to his upper right thigh.
Baltimore Police found a trail of blood and the victim’s vehicle at the scene. Court documents state the victim later identified Nelson as the shooter from a photograph.
