Defense Points to ‘Dearth of Evidence’ in Pimlico Road Homicide Trial

Counsel gave closing statements in the homicide trial of 25-year-old Darrean Fleming before Baltimore City Circuit Court Judge Lynn S. Mays on Jan. 10.

Fleming is charged with two counts of first-degree murder as well as one count each of having a handgun in his vehicle and using a firearm in a felony or violent crime. 

He and his codefendants – 22-year-old Wesley Lambert and 24-year-old Garry Morris – were accused of murdering 20-year-old Amare Burruss in a drive-by shooting on Dec. 7, 2022. The trio allegedly chased Burruss from the 4400 block of Park Heights Avenue to the 4200 block of Pimlico Road, where police responders found Burruss deceased with a gunshot wound to his head. 

Footage from the area of the incident captured Burruss allegedly firing nine times from a 9mm extended gun, presumably toward the trio. Two of the bullets punctured a nearby school bus occupied by two individuals. 

Defense attorney Michael Tomko asked the jury to find Fleming not guilty on all counts, and that the outcome of the case hinges on “a dearth of evidence.”

“There is no video evidence of the shooting,” said Tomko. “Think about what you’re not being told.”

The trial continues Jan. 11.
