Old Frederick Road Shooting Suspect Weighs Bench Trial After Plea Offer

On Nov. 28, a 20-year-old non-fatal shooting defendant appeared before Baltimore City Circuit Court Judge Melissa M. Phinn to hear the prosecution’s plea offer.

Cameron Cunningham is charged with first- and second-degree assault, reckless endangerment, firearm use in a felony violent crime, having a loaded handgun on his person and in a vehicle, firearm possession as a minor, illegal possession of a regulated firearm, firing a gun in Baltimore City, illegal possession of ammunition, having a handgun in a vehicle, failure to stop for an accident and driving without a license in connection to a May 26 incident.

The prosecutor offered Cunningham 20 years, suspending all but 10 years, for first-degree assault; a concurrent five years without the possibility of parole for firearm use in a felony violent crime. The plea offer would also require guilty pleas for failure to stop for an accident and driving without a license, but would not entail any sentencing agreement for these charges. Cunningham would also be required to serve four years of probation and have no contact with the victim upon release.

Cunningham discussed the plea with Roland Harris, who was standing in on behalf of defense attorney Martin Cohen. Then, Harris told the court his client was considering a bench rather than a jury trial and asked if Judge Phinn would continue the hearing to Dec. 1. 

Judge Phinn said that scheduling a bench trial or jury trial would not require any additional information not available to the court today. She scheduled Cunningham’s trial to begin on Jan. 29, 2024, and that she would be the presiding judge.

A Baltimore Police Department press release states that Cunningham is the suspected assailant in the shooting of a 27-year-old woman on the 3400 block of Old Frederick Road. The victim suffered a graze wound to the head, and received treatment for her injuries.
