Judge Signs Order To Release Defendant’s Records

A juvenile, who is being charged as an adult with first-degree murder, was granted a motion for the subpoena of his Department of Social Services records at the Baltimore City Circuit Court on Oct 21.

Damonyae Malone, 16, is being charged as an adult with first-degree-murder and firearm use in a violent crime for alledgedly shooting 15-year-old Jaileel Jones in the head after an argument on the 5100 block of Chalgrove Avenue on March 4.

Defense attorney Sasha Garcon requested a motion for a subpoena for tangible evidence for Malone’s Department of Social Services records.

The Department of Social Services representative said the defendant met the burden for need to inspect the records and approved their release. However, the representative  had two requests: 1) restrict the ability for the defendant to alter information on his siblings, and 2) his parents requested that their address be shielded on the reports due to threats.

Garcon and the prosecution had no objections to the requests, and the motion was granted.

Judge Erik S. Atas signed the order to release Malone’s records.

The defendant is currently scheduled to have a juvenile transfer hearing during reception court on Nov. 30.
