Judge Schedules Trial for Two of Three Co-Defendants Charged in 2022 June Murder

On Dec. 9, two Baltimore residents charged with first-degree murder rejected a plea of life before Baltimore City Circuit Court Judge Melissa M. Phinn

Defendants Theodore Richards and Antuan Dubose rejected a plea of life, suspending all but 50 years for two counts of first-degree murder and the use of a firearm during a felony violent crime in connection to the fatal shooting of 36-year-old Damon Bailey on the 1800 block of West North Avenue on June 10, 2020. They are joined by a third co-defendant Justin Westbrook.

Richards, 37, is represented by Brandon Patterson, and Dubose, 33, is represented by Robert Cohen and Janet Anderson

The prosecutor informed the court that she would be filing a motion to try all three co-defendants together before Westbrook’s trial in February 2023. 

Initially, all of the defendants were supposed to be tried together; however, the prosecutor was out sick, causing the co-defendants to be split up due to scheduling differences.

Dubose and Richards’ trials are scheduled for July 12, 2023, with Judge Yvette M. Bryant presiding. 

Westbrook’s trial is scheduled for Feb. 22, 2023.
