Baltimore City Circuit Court Judge Lawrence R. Daniels cancelled murder defendant Devin Curry’s trial on Aug. 5 pending review of a so-called interlocutory appeal before final judgement is made in the case
Curry, 20, is charged with first- and second-degree murder and assault, as well as numerous firearm-related violations, for allegedly shooting and killing 52-year-old Daniel Pitts Jr. near the n April 14, 2022.
According to charging documents, Pitts was found dead in his truck with a gunshot wound to his head. Photographic evidence reportedly shows Curry producing and discharging a gun at Pitts.
Jurors in Curry’s previous trial failed to reach a unanimous verdict before Judge Charles H. Dorsey III in 2024, leading the court to declare a mistrial. Curry filed a notice of appeal, stating a retrial would violate his Fifth Amendment right of protection from double jeopardy and citing “several anomalies with how the jury communications were handled,” note court documents.
The court upheld the postponement of the trial, noting that proceeding with trial would cause substantial preventable waste of court resources.
The trial will continue following the resolution of the appeal. The court has yet to set a date for further proceedings.
