A 67-year-old convicted homicide defendant was handed down a 10-day prison sentence on Feb. 23 for violating his probation after being arrested for a DUI.
According to defense attorney Sharon Dubey, her client, Anthony Thompson, was arrested for a DUI in March 2022 when Baltimore Police found the defendant sleeping in his car with an open alcohol container and car keys on the front passenger seat. His probation was set to expire six months later on Aug. 14, 2022, in connection to his second-degree murder conviction from 2009.
Thompson was initially sentenced to 30 years, suspending all but 15 years, and five years of supervised probation for the crime.
When given a chance to speak, the defendant told Baltimore City Circuit Court Judge Anthony Vittoria that he was at a woman’s house working on her car and had some drinks. Rather than drive intoxicated, he continued, he decided to sleep it off in his car when he was arrested and charged with several traffic violations, all of which were dismissed, excluding the DUI.
The prosecution recommended a three-year sentence.
Judge Vittoria informed the court that he could not extend Thompson’s probation for the DUI as his probation had already expired; therefore, he sentenced the defendant to 10 days of incarceration and one year of probation.
