After Witness Fails to Appear, Prosecutor Dismisses Attempted Murder Charges

The prosecutor of an attempted murder case dropped all charges against a 45-year-old defendant after the victim did not show at trial.

Eric Davis is charged with attempted first- and second-degree murder, first- and second-degree assault, firearm use in a felony violent crime, reckless endangerment, firearm possession with a felony conviction, illegal possession of ammunition and discharging a firearm in connection with a 2022 non-fatal shooting.

The prosecutor requested that Baltimore Circuit Court Judge Jennifer B. Schiffer postpone the trial on Sept. 21 to allow her another chance to secure the witness. However, Judge Schiffer did not find cause for postponement, so the prosecution dismissed the case.

The defendant was represented by defense attorney Thomas Rafter.

According to charging documents issued by the District Court of Maryland, on Aug. 22, 2022, Baltimore City Police Department officers responded to a ShotSpotter alert. Officers found a man who, according to medics, was shot approximately 17 times on the 1200 block of Ward Street. A witness to the shooting identified Davis as the suspect using a photographic array.
