On Nov. 13, Baltimore City Circuit Court Judge Melissa M. Phinn scheduled an alleged “39 Babies” gang member’s trial for next summer.
Keith Miller is charged with participating in a criminal organization, conspiracy to commit an unlawful act, conspiracy to distribute narcotics, attempted first-degree murder, firearm use in a felony violent crime, firearm possession with a felony conviction, possessing a fentanyl-heroin mix with intent to distribute, several counts of possessing narcotics with intent to distribute and possessing controlled dangerous substances that were not marijuana.
Miller, 34, is one of 33 codefendants charged with gang activity in the “39 Babies” gang that the Attorney General’s Office split into nine groups of co-defendants that will be tried separately.
The assistant attorney general issued an aggregate plea offer of 20 years, the first five years without the possibility of parole, for participation in a criminal organization, attempted first-degree murder, firearm use in a felony violent crime and possessing narcotics with intent to distribute.
Miller rejected her offer.
Though defense attorney Roya Hanna told the court she had availability in February and April 2024, the assistant attorney general was unavailable until June 2024.
Judge Phinn scheduled Miller’s trial for June 3, 2024, through June 21, 2024.
