Homicide Defendant Acquitted of Murder in 2016 Headed to Trial for Fatal Shooting A Year Later

After he was acquitted of murder charges over six years ago, Baltimore resident Wayne Demetrius Smith Jr. is facing charges in another homicide in 2017. His trial was postponed on Dec. 8 before Baltimore City Circuit Court Judge Dana Middleton

Smith, 24, is charged with two counts of first-degree murder, two counts of use of a firearm in a violent crime, two counts of conspiracy to commit first-degree murder, illegal possession of a regulated firearm, possession of a firearm as a minor, and illegal possession of ammo for an incident on April 29, 2017. 

On Wednesday, a court bailiff informed Baltimore Witness that the case was postponed but did not provide further information. Attempts to contact Smith’s defense attorney, Bradley MacFee, were unsuccessful. 

According to the Maryland Judiciary website, Smith’s next court appearance is scheduled for June 21, 2022.

Smith was found not guilty of first and second-degree murder in December 2016 in connection to the fatal shooting of 28-year-old Avery Kelly about a year prior, the Baltimore Sun reported.
