Counsel in a homicide case for three co-defendants struggled to schedule a trial date during reception court on Aug. 24 at the Baltimore City Circuit Court.
Devon Bynum, 18, Kiray Walker, 20, and Malik Brooks, 21, are charged in connection to a homicide on Nov. 14, 2019, and are represented by defense attorneys Donna D’Alessio, Catherine Flynn, and Martin Cohen, respectively.
Bynum is charged with first-degree murder, conspiracy to first-degree murder, and using a gun to commit a crime. Walker and Brooks are charged with first-degree murder, conspiracy to first-degree murder, and firearm use in a violent crime.
During Tuesday’s proceedings, the Baltimore residents were offered pleas from the prosecution.
Bynum was offered life, suspending all but 50 years, with five years probation to run concurrently for two counts of first-degree murder. In addition, the prosecution would dismiss the remaining charges as well as Bynum’s other cases, which were not discussed.
Walker and Brooks were offered life, suspending all but 60 years, with five years probation. The prosecution’s offer would also dismiss Walker’s remaining charges and three other cases, and dismiss Brooks’ remaining charges and four other cases.
Each defendants’ respective defense attorney rejected the offers.
Although currently scheduled for trial on Dec. 29, the defense attorneys informed Judge Melissa M. Phinn that they would not be available to try the case until the new year. Judge Phinn said they will return to reception court on the scheduled December date and must then agree on a trial date for March of 2022.
