A father and son accused of a shootout that left a 34-year-old man in critical condition in Central Park Heights earlier this year are expected to be tried separately for attempted first-degree murder and other weapons violations in October.
On Sept. 15, defense attorney John Deros rejected the prosecutor’s plea offer for 29-year-old Therron Antonio Spencer that included 50 years, suspending all but 30 years, and five years of supervised probation for attempted first-degree murder and a concurrent five years without parole for using a firearm in the commission of a violent crime.
Spencer’s father, 49-year-old Brandon Therron Spencer, was not scheduled during Tuesday’s reception court proceeding before Baltimore City Circuit Court Judge Melissa K. Copeland. However, he is facing similar charges.
The prosecutor informed Judge Copeland that all evidence was shared with defense counsel. She noted that she is in contact with the victim and anticipates five to six witnesses at trial.
Counsel agreed on a three-day trial, beginning Oct. 19, before Judge Robert K. Taylor Jr. Although the father and son will not be tried together, the prosecutor requested Brandon’s case occur on the same day before Judge Taylor — a request granted by Judge Copeland.
According to court documents, Therron and Brandon were at a cookout on the 3100 block of Oakford Avenue on March 30 when Brandon became upset about the male attendees, leading to an argument. When the victim stepped in-between Brandon and the others involved to deescalate the situation, witnesses reported Brandon shot the victim.
The victim was shot in the jaw, legs and lower right back and taken to Sinai Hospital in critical condition.
City surveillance footage reportedly shows Therron also firing multiple shots at several people before jumping over a vehicle and continuing to fire on the 4400 block of Park Heights Avenue. Court documents state he was last seen on camera running westbound on Oakford Avenue.
Baltimore Police found several cartridge casings and suspected blood evidence on the ground at the crime scene.
