On Sept. 11, Dion Khun Jr., rejected the prosection’s plea deal. After his rejection, Judge Melissa K. Copeland scheduled his trial to begin in December.
Khun, 36, is charged with 12 counts, including attempted first-degree murder, attempted second-degree murder, first-degree assault, firearm use in a felony violent crime, second-degree assault, firearm possession with a felony conviction, handgun on person and reckless endangerment.
In reception court, the prosecutor offered a plea deal of life suspending all but 35 years, five years of supervised probation, no contact with the victim, and the defendant must register as a gun offender. Additionally, the plea also stipulated that he serve five years without the possibility of parole for firearm use in a felony violent crime.
Defense attorney, Lawrence Rosenberg, standing in for Michael Tomko, rejected the plea offer.
On April 12, at approximately 3:13am, the Baltimore Police Department (BPD) received notification about a shooting victim located on the 1800 block of Falls Road. When officers arrived, they located a victim, suffering from six gunshot wounds to the body and arms. The victim was transported to John Hopkins Hospital.
Shortly after the victim arrived, police were called to the same hospital for gunshot wounds for two other men, including Khun, according to charging documents. Both men said they were at Club Element, located on the 1800 block of Maryland Avenue, when a dispute with a female led to several men shooting at them.
Nearby surveillance footage captured a group of both men and women, including the victim. In the footage, a white Acura parks nearby nearly out of camera view. Three males, including Khun, approached the victim’s group. One of the men is seen striking the victim in her face.
Following the altercation a male from the victim’s group drew a firearm, but did not fire. A male from Khun’s group also pulled out his handgun, and began firing toward that male. Khun and an unidentified person, who also arrived in the Acura, began firing as well.
This altercation caused the victim, Khun and another male to have multiple non-life threatening gunshot wounds.
Khun’s trial is set for Dec. 1 through Dec. 3 with Baltimore City Circuit Court Judge Robert K. Taylor presiding.
