Acquitted of murder in a mass shooting, Eric Byrone Kibler, 44, will stand trial again for conspiracy to commit murder and related charges in connection to the Aug. 18, 2024 murder of Anthony Martin, 36.
The matter was scheduled to come before a jury on Aug. 26 but was postponed for lawyers to consider the massive amount of evidence in the case.
The incident occurred on the 1300 block of N. Spring Street on Aug. 18, 2024. According to charging documents, a parking dispute involving members of the Thunderguard Motorcycle Club escalated, resulting in a shooting that wounded seven and resulted in Martin’s death. Surveillance footage allegedly captured the defendant, who was armed with a handgun, as one of the shooters.
Kibler was initially charged with 47 counts. However, he was acquitted on two counts of first-degree murder charges, seven counts of attempted murder, and multiple gun offenses at the initial jury trial on March 23. Kibler was found guilty of handgun and firearm possession and sentenced to 15 years in prison.
Kibler is being retried on the remaining charges, which include conspiracy to commit murder resulting in death, conspiracy to commit murder (non-fatal), assault in the first-and-second degree (non-fatal), and two counts of use of a firearm in the commission of a crime of violence.
At a hearing before Baltimore City Circuit Court judge Cynthia Jones and continued before judge Melissa Copeland the state and defense attorneys mutually requested to postpone a retrial because lengthy transcripts and recordings needed for the trial were delayed.
The trial scheduling date is set for Oct. 16.
