Mistrial Declared in Family Dollar Murder After Juror Says, ‘The Defendant is Cooked’

A mistrial was declared June 16 in the case of Braxton Day, 40, after the court was informed that at least one juror on the panel had researched the case.

According to Baltimore City Circuit Court Judge Jeannie J. Hong, the juror told fellow members of the panel that, “The defendant is cooked.”

Day is charged with manslaughter, firearm use in a felony violent crime, having a handgun on his person and firearm possession without a serial number. Authorities believe he fatally shot 42-year-old Bryant Breland on May 31, 2025, following an altercation at a Family Dollar store located on the 600 block of Cherry Hill Road.

Before the mistrial was declared, a medical examiner testified that Breland’s death was a homicide caused by a gunshot wound. Surveillance footage reportedly captured Breland initiating an altercation with Day, who then shot the victim in return.

Defense attorney Maureen O’Leary moved for a mistrial shortly after the court learned that at last one member of the jury had researched the case. Judge Hong promptly declared a mistrial after expressing concerns for the jury’s objectivity.

A new jury will be selected later on June 16.
