Judge Grants Release After Filing Error In Shooting Case

Baltimore City Circuit Court Judge Martin H. Schreiber II allowed Chavez Scott, 39, to be released on home detention with electronic monitoring during bail proceedings on July 25.

Scott is charged with having a handgun on his person, having a loaded handgun on his person, and discharging a gun in Baltimore City in connection to a non-fatal shooting incident that occurred on July 7.

Defense attorney Rodney Gray claimed that during Scott’s previous bail hearing, the prosecution made an incorrect statement, alleging that Scott did not have a wear and carry permit. Gray included a letter from the Maryland State Police in his petition verifying that Scott had a valid wear and carry permit on the date of the incident. Judge Schreiber accepted the authenticity of the permit during the bail hearing.

Scott was also present at the scene when officers arrived. Officers recovered the firearm and the holster used in the incident, which Gray alleged was proof that Scott was wearing the gun properly.

The prosecution held its position to have Scott be held without bail, claiming that multiple threats were made against the victim before the firearm was discharged.

Pre-trial services verified that Scott has no conviction history and recommended that he be allowed to work.

Judge Schreiber allowed Scott to be released on home detention. In his reasoning, Judge Schreiber stated there was “significant error in district court proceedings”. Although troubled that this was a domestic violence incident, Judge Schriber was influenced by the fact that there was no history of domestic violence in Scott’s record. Judge Schrieber also said his decision was influenced by the fact that Scott is “gainfully employed and otherwise fairly law-abiding”. 

Scott’s trial is scheduled for Aug. 7.
