Prosecution displayed evidence for the jury that will deliberate the charges of Sean Cherry in connection to a shooting that happened at a convenience store on Cold Spring Road on September 16, 2023. Two were shot and two more escaped unscathed.
Cherry is currently facing four charges for attempted murder in the first and second degree, assault in the first and second degrees, reckless endangerment, and possession of a firearm, as well as one count of illegal possession of ammunition, one count of possessing a firearm after a previous felony conviction, and illegally firing a firearm in Baltimore.
Body cam footage a police officer called into testify reveals that the four victims fled to the house of one of them, located a block from the convenience store where the shooting occurred. In the videoclip, the officer enters a dark living room, where two men lying on the floor groaning in pain. The officer and the two other victims shared a loud exchange, revealing that they did not know who the shooter was.
Previously, a case investigator had noted that the shooter was neither identified by any of the victims after arriving at the hospital. Instead, a tip suggested Cherry to be a shooter, with Cherry being detained after one of the victims identified him as a shooter from a photo reference.
A transit patrol officer would place Cherry at a bus stop near the convenience store shortly after the shooting after a photo he took of was displayed in court. He would identify the man in the photo as Cherry, who sat in front of him, by his “unique nose”.
The aforementioned case investigator also described that at the scene of the crime, he found .380 caliber bullet casings and a number of personal items scattered on the ground. During cross examination, he suggested the casings had come from a semiautomatic firearm with a 5-12in barrel, though could not trace the other objects to their owners. No weapon has yet been recovered.
The court was excused to take a lunch break at noon. Closing statements were made later in the afternoon.
