Trial of Alleged ‘39 Babies’ Gang Member Ends

Parties debated over whether a 39-year-old defendant was a high-ranking member of the “39 Babies” gang at the end of his trial before Baltimore City Circuit Judge Alan C. Lazerow.

Keith Miller is charged with participating in a criminal organization, conspiracy to commit an unlawful act, conspiracy to distribute narcotics, attempted first-degree murder, firearm use in a felony violent crime, firearm possession with a felony conviction, possessing a fentanyl-heroin mix with intent to distribute, several counts of possessing narcotics with intent to distribute and possessing controlled dangerous substances that were not marijuana.

During closing arguments, the prosecution presented surveillance footage that she argued showed Miller having a handgun and firing twice at the victim on Dec. 19, 2022, at the corner of Frederick Avenue and Calverton Road.

Phone call recordings were also presented in court, with the prosecution arguing that Miller was talking about selling and cooking drugs with others, emphasizing that Miller was a high-ranking member within the gang which has been linked to many serious crimes.

Given Miller’s prior convictions, it was noted that he was prohibited from owning or using a gun.

Miller’s attorney, Roya Hanna argued that the videos were not clear enough to recognize specific people. Hanna also stated that the prosecution lacked evidence, such as fingerprints, DNA or GPS records linking Miller to the crime.

Hanna also argued that the phone call records couldn’t prove anything if the jurors approached them remembering Miller’s presumption of innocence.
