A Baltimore City Circuit Court judge tentatively scheduled a March trial date for homicide defendant Tayvon Miller on Jan. 2, despite defense counsel’s unavailability until May.

Defense attorney James Sweeting III informed Judge Melissa K. Copeland that he would not be available for trial until May; however, Copeland said, the judges’ trial schedules are not currently open.

Judge Copeland set Miller’s four-day jury trial to begin on March 4 before Judge Alan C. Lazerow.

Last month, the 37-year-old defendant rejected the prosecution’s plea offer of life, suspending all but 60 years, and five years of supervised probation for first-degree murder and a concurrent 20 years, the first five years without parole, for firearm use in a felony or violent crime.

In addition to the aforementioned charges, Miller is also facing charges of armed robbery and firearm possession with a felony conviction for an incident on June 28, 2023.
